Rapidshare Uploads Privacy Policy

After recent court ruling against Rapidshare the leading file-hoster has now uploaded a privacy policy to address user concerns regarding privacy with usage of their services, the well laid privacy-policy provides all the necessary information to address user concerns, however it has some clauses which might be concerning like :
Will RapidShare pass information about uploaders on to third parties?
If we are legally obliged to turn over information about the origin of a file, we will fulfill that obligation. The legal circumstancees will be evaluated individually in each case. Without a legal basis, no information will be given to third parties.
However, the policy also states :
I want to become Premium customer but am seriously afraid that RapidShare has also fallen for the monitoring hype and is secretly logging everything I do in order to create some kind of profile or to abuse the data in any other way.
- Even if we wanted to do so (meaning we would risk to be prosecuted by millions of customers), we couldn’t implement that technically. Per day there would occur several billions of log entries. It’s technically impossible to gather this amount of data without investing a sum in the hundreds of millions of Euros.
- Furthermore, the storage of download logs is prohibited in many countries. If anyone should legally try to force us to monitor customers to such an extent, we would gladly go through all levels of jurisdiction in order to avoid that.

First it say “IF legally obligated”. This is more then understandable. If YOU upload illegal files and are caught doing so it’s your butt or there’s…whose butt is Rapidshare going to save???
DUH! Don’t see what the big deal about this statement is. Plain, simply and straight forward to me!!! When you sign up to use the website it’s in the agreement you click you understand in the first place.
Simple solution DON’T use Rapidshare for you illegal files or don’t get caught!
